Not necessarily. You get GPLv2 patent protection for the mere fact that you're forking a GPLv2 stuff. Now, the debate is: is this enough? Who knows. I don't think that the TCK gives you more patent protection. In the practical world, it's rather possible that since you have to ask for the TCK to Oracle, in the negotiation for it Oracle gives you further protection.

But I suppose the IcedRobot guys did study this a lot. Maybe we could ask to them. I suppose Mario Torre is not on this list, right?
