Whether they are fair or not it's over simplistic to say team that finishes 3rd should go up. You could have a situation where third best team qualifies with a few weeks to spare then rests players, takes the foot off the gas, doesn't play quite so hard to prepare for the 3 games and hence finishes 4th or 5th which can be good enough compared to playing hard for all 46 games to ensure they finished third.
