I do not know if you are trying to update using the update from the Web or the full version.
I recommend you use the full update version and tell IE to save the installer file in a folder on your hard drive. I recommend using My Documents not the desktop since the icon for the installer and Legacy are the same, if both are on the desktop you can be confused over which one is the installation and which is the working program.
