I'll check with the Lego people and see if they object to NeXT. Legally I don't know if they can since they can't trademark a common word like Next.

With regards to Steve Job's NeXT, I don't think that's an issue because ours is called leJOS NeXT, not just NeXT. I'm not up on whether it matters which letters are capitalized or not though. NeXT is defunct as far as I know.

I don't think I understand what you are saying here exactly. Are you saying to host all the files on the leJOS Sourceforge Project? In other words, would you download the same code that would work with either the RCX or the NXT? Please expand on what you mean by interoperation via the host computer.

Also, the intro page to the developer program says
that there will be an NDA:

Good point. We could keep the Developer forum private to whoever receives an NXT kit until Lego officially releases the kit and the NDA evaporates.
