Maybe, but I sense they are in a difficult position.
For whatever reason, they have drawn this hard line between proprietary and
open source OS.
And having taken this position, they are trying to avoid creating *any*
loopholes or precedences where "proprietary OSs" could become "open OS's".
If they agree that a layered OS like Cygwin is an open source solution,
maybe they are worried that a real, full blown proprietary OS would be
classified as open too (OpenVMS anyone?) Hence they have drawn a very firm
line in the sand.
I don't really know what they are thinking here, just guessing like
everybody else!
