Of course, yet  this is how far a protection of a society from any abuse goes. 
i think the main problem is the value system, especially in USA.

  What you have described would be the case in a capitalist or free 
  market economy. If someone(s) were harmed by the product the 
  manufacturer would be legally liabel if the consumer used the 
  product properly. If a worker were harmed unless it was due to his 
  own negligence the factory owner(s) would be legally liabel.
