Paragraph marks have no meaning in the ODF document. Rather they are a
graphical representation of the transition from one Paragraph object to the
next.

You are not selecting the Paragraph marker! Rather the paragraph (empty or not,
direct formatted or styled) *and* the transition mark. 

The direct formatting or style of the paragraph may or may not be carried to
the start of the following paragraph, which otherwise receives default
paragraph style, behavior will depend on what is selected (just the paragraph
object, or the paragraph and its transition marker).

This is absolutely consistent.

IMHO works as expected and => NAB
