Don't know about MS-DOS (haven't seen one in many years), but in Windows
XP command shell (cmd.exe):

C:\>dir test.txt
Volume in drive C is VAIO
 Volume Serial Number is 334A-0FE5

 Directory of C:\

File Not Found

C:\>copy con test.txt
^Z
        1 file(s) copied.

C:\>dir test.txt
Volume in drive C is VAIO
 Volume Serial Number is 334A-0FE5

 Directory of C:\

               1 File(s) 0 bytes
               0 Dir(s) 1,931,493,376 bytes free

don't count it, right?
