Unless you have filled out PAT form 15 and paid your $337.50 they won't consider it. I rang and asked if there was any other way. There wasn't.
Sucks, doesn't it? Feel free to ring them and ask why it is so expensive. 0508 447 669
Errr its not the expensive part. Wait until you go throught the rest of the procedure.
These are complex legal procedures, just like if you were involved in any other litigation, and with the risk of it costing you both arms and a leg.
Complex? Do I need a lawyer to object to a patent? Is it not enough to read the relevant section of the Patent Act (and, of course, the patent application itself) and point out to IPONZ where the patent application violates the Patent Act? I'm pretty sure I have enough brains to get that far.
The patent objection form itself is not very complicated. In fact, the most complicated part of it is the payment options part.
I just can't see the justification for charging *more* for a patent objection than for the patent application itself.
Or is there something I'm missing in my legal naivity?
Cheers, Carl.
