As with most people, they will use whatever mechanisms are afforded to 
them, to gain advantage.  Don't expect idealism from people who have a 
dispute.  Expect it from those who are supposed to be uninvolved.

NSI is the problem, in this case, not the trademark community, because NSI 
is choosing to give the extra rights to trademark holders.
