Certainly it is.

Arguments have been put out there that the entire concept is flawed.

It is most definitely an issue at the moment.

I present that this concept is a lot of the cart before the horse.  You want to
argument that chartered TLDs may or may not solve TM concerns, and that is well
and good, but does it serve the greater good, and at what cost? 

Those issues are equally (more so IMHO) important to whether they answer TM
concerns.
