Yes the optimal term here is "As Implemented", referring to the bylaws.
There are other problems with the bylaws as Karl A. has nicely
pointed out on several occasions, and just afterwards lately, Joe
Simms discontinued discussing them or any possible changes
that could or should be considered in order to rectify those
Bylaws problems. To me anyway, this is an indication of lack of
proper responsibility on the part of the ICANN (Initial?) and Interim
Board, that signifies to a great extent their lack of qualifications
to be serving in their current capacities...
