It's not about "speaking a language"; it's about a reference to
"ethnic or national origins."

See UK 2010 Equality Act:

if we use the word "native" at face value ("associated with the place
or circumstances of a person's birth.").

Ironically, a native English speaker would not use this wording. I
have hardly seen any reference to "native speakers" in work or
volunteering vacancies in 20 odd years of living in UK.
