While they can argue over the original offer, the use of a photo seems to me to be much less 'debatable' under law. Who's photo is it? DId they get permission to use it? If they didn't, threaten a claim for breach of copyright via the small claims court. Then there's the privacy issue. . . . On the basis of the Zeta-Jones/Douglas case, who knows. . . . . .
