Is there some way that I can tell the app to quit (rather than forcing it to 
quit, which I believe may have some negative consequences if its state is not 
saved) without having to make it active?

Some apps are worse at this than others.  NetNewsWire seems particularly poor, 
taking a long time to become active again (probably because I have a large 
number of subscriptions with posts).

Other apps aren't too bad. MS Office apps usually change in a few seconds to 
offer the "Quit" option (rather than "Force Quit") *after* I  have displayed 
the Dock menu once and waited.  

Is this just a result of poor app design or is there something Apple could do?  
I wouldn't even really mind if they faked a "Quit" option (as well as FQ) when 
the app was inactive, i.e. it tried to make the app active and then quit.

Nothing to protest too much about but just something that annoys me regualrly.
