Fleeing felon alone is no longer adequate justification in california (and this shouldn't surprise anyone). For a cop to shoot a fleeing felon - the courts have gotten pissy in the past with cops shooting non-violent felons (like grand larceny or forgery), or felons that otherwise do not present an immediate threat to life.
