I should know better by now.

All the points ( red herrings ) you laid out are interesting but moot. 
Effigies, posters, publications and so on are covered by our bill of rights. 
For now at least.

The discussion is hate speech vs. free speech.

"Hate" is just an empty box with the label "hate" stuck to it. Any asswipe can 
toss whatever they like into the box and !presto! we have a working definition.

Even using the term "hate speech" is tautological. I am not convinced that such 
a thing exists in a non-politicized sense.
