Wouldn't this mean that anyone who had a superbowl party at their
place, with over a certain amount of people, violated the law if they
watched it with their mythtv or tivo? You are displaying a recorded
program even if it is almost live.


It is not quite so cut and dried. There are timeshifting provisions, definition of what constitutes an audience. The portability or writing of content to DVD could introduce addition restrictions compared to watching it timeshifted on a local non-portable device. I'm no lawyer but it is not as simple as "a is good and b is bad". There's lots of permutations which is what makes it all such a confusing mess to begin with.
