If someone intends to hack around in this manner, he can download
those header files from opensolaris.org, package them up with his
driver, and ship that.

It'd be no more or less sane to do that than to ship the header files
with the packaged software.  As long as there's no stability here,
you're just as hosed using stale header files as you are using stale
binaries on an upgraded system.
