Actually the JOSM-Validator is doing a very good job when it comes to crossing ways. It's warnings are 100% correct for me for 3 months now: You get a "crossing ways" warning if two ways cross without sharing a node *and* not being tagged with different layers. As soon as you add a correct layer tag to the bridge/tunnel way the validator-warning is gone.
