Hmm, technically, the data going over the network may not have originated with the phone, but it is coming from a application on the phone. Just the application on the phone is servicing something besides the memory, screen, or speaker. And on reading deeper into AT&T marketing and TOS, they conflict each other heavily. Looks like the TOS is way behind. Specifically the marketing for the PDA plans sell the idea of hitting media rich websites and services, but the TOS says you can not connect to anything but the intranet including your company intranet.
