We have the snowden leaks. We have stuxnet, which used legitimate certificates that the virus creator (CIA) used for application signing. Of course verisign says these were stolen. We have the AT&T whistleblower who claimed there were cabinets being installed to suck up all traffic between backbone providers.
You really have to assume they have access to almost any data in transit.
