Says who?  Why would you have to prove your product was incompatible to say that it is incompatible with something?

I don't have the OGL in front of me, but does it have any language preventing you from stating incompatibility UNLESS the item in question is Product Identity, in which case you may not be able to use it at all.

In part this may be a question of the SRD version.  I think the newest SRD (again, don't have it in front of me) lists Dungeons and Dragons as product identity, right?

In any case, I don't think this is a matter of proving incompatibility.
