I think what we have here is a misunderstanding of semantics.  The way you
used the word "close" confused me to the intent of your message.  After
reading your reply I understand the point that you are making.

My point was that any content that is covered by the OGL or the D20SRD is
"Open" and cannot be "Closed."  As the owner of the D&D3E IP, they can
develop new products based on that IP.  It is their choice as to whether or
not any new rules, spells, items, classes, etc. are added to the D20SRD or
otherwise made available for Open use.
