We're talking about two different sorts of products and using the term "d20"
to describe both.

d20 meaning based on the d20SRD, yeah, you can do whatever you want. You can
write your own PHB if you want.

d20 meaning part of the family of products bearing the d20 logo, then no.

So it seems we're in agreement.
