Maybe I'm just paranoid, but if I were WotC, here's what I'd do:

I'd take you to court.
My stance would be that you took our un-OGL'd info, and used it.
"But you can't trademark/copyright/patent a game mechanic"
True, but we are hear to show the court that we Should be able to... by
proving how screwy the current lack-of-laws is.

You OGL'd your PHB.
You want people to use it for d20, an idea that We pioneered and own the
trademark to... It is Obviously a ploy on your part to circumvent our
IP.

Ta Da!  The judge rules in favor of WotC and people can now take steps
to protect their gaming systems.

The WotC sits down and cries because there is still nothing they can
about Palladium ;)
