You might be right, but that argument would have vast, far-ranging
consequences and I don't think many judges are ready to make that kind of
law right now.
I'm also not convinced WotC is interested in trying. The only thing I am
sure about is that they don't believe the OGL portion of the d20 SRD is
worth protecting without the trademark link back to D&D. If they did, they
wouldn't be placing it under the OGL.
As Ryan has said over and over, the value is in the Brand, not the
mechanics, and certainly not in character creation. Subverting the d20 STL
to make your own d20-logo'd PHB will be much more serious to them than
creating an OGL PHB.
