Since the distribution is a zip file, I'd say that including the license as
a separate file is ok.
This line from the readme:
"The Craft of the Mind is a "Psionics" system based heavily on the rules in
the Dungeons and Dragons' Players Handbook, and intended for use with it.
(The name "Psionics" is not used to differentiate this from WotC's upcoming
system, and any conversion of the 2e system.)"
Is not ok, because it uses "Dungeons & Dragons", which is product identity,
and "WotC", which should be. (I should add this to the Overview D20 SRD).
I would not include the sentence after "Doug Meerschaert":
"The Craft of the Mind is copyright 2000 Doug Meerschaert. It is derivative
of the D20 System Reference Document, Copyright 2000 Wizards of the Coast."
Because it violates the Product Identity clause ("Wizards of the Coast"),
and it is unnecessary.
I would have a lawyer examine:
"Permission is expressly granted to use the trademark "The Craft of the
Mind" in works following the D20 Standard Reference Document (or some other
license approved by the owners of the d20 trademark.)"
I don't know what a "work following the D20 Standard Reference Document" is.
You might want to say "works complying with the terms of the D20 System
Trademark License" instead.
My legal department is going to talk to me this week about these kinds of
"add on" licenses. I have a concern that they may be revokable at will, and
shouldn't be used. This isn't a critisism of Doug (I've used something
similar to this construction in the Overview chapter for proper nouns in
spell names). I think that this language may have to be extended in some
way to avoid future problems.
" I coined the names "The Craft of the Mind" to refer to the system as a
whole, and "Mindwalker" to mean the class. I claimed these names as
trademarks so as to provide some focus to this whole thing, and add clarity
to what "The Craft of the Mind" is."
You can probably attempt to trademark "Craft of the Mind", but you won't get
"Mindwalkers". That term has been used in several sources, including
Alternity.
Next Steps:
Put the OGL into the License.txt file
Update the COPYRIGHT NOTICE portion of the License with the correct
attributions.
