The 5% OGC requirement is in fact what stopped us from using the d20 STL.
For commercial reasons we would have much rather put this book out with the
d20 logo. Had we to design the product over again we would have worked
harder to add content that would meet the 5% requirement and thereby use the
d20 STL (and OGL). We actually discussed this on the list awhile back when
the book went to press.

Also, I don't think Mike's original post was bitching, just commenting on
the odd and possible portentous lack of the d20 logo on the Scarred Lands
Gazetteer.
