The issue with BoEM is that a large protion of the book is clearly derivative of the SRD and therefore needs to be clearly identified as OGC but is not. The Monster Template:Magical construct is the only part of the book clearly identified as OGC, the rest is identified by the statement that anything derivative of the SRD is also OGC. The new feats, classes & spells all derivative of the SRD in the game mechanics at least and are therefore required to be OGC. The magazine was not published under the OGL and therefore can not contain any OGC. If you want to use what the magazine mistakenly points to as being OGC you must go to the original products being mentioned.
