Only if he was using the d20 STL.  If he is using just the OGL, then he
could technically go to 99.99999....(lots more nines here)....999% closed.
You may even be able to go 100% closed, like the Dragon Annual, but I'm not
sure if 3rd Party Publishers are allowed to print the OGL without declaring
"something" as OGC.

An unpracticle, but totally legally action would be to have the OGL included
in a product that consists of 1000's of pages of text, and only declare a
single word as OGC.
