OIC - because the term is used in the context of the "illithid" character, 
and the "illithid" is a copyright character of WotC.

So any work that uses the "illithid" character without a license (and since 
it is not in the SRD there is no license) would be derivative.

It just seems a stretch to call "an invented term for a tentacle-faced 
creature" a character.  I though the character theory only applied to unique 
characters (i.e. proper names of individuals).
