I seem to remember that the original purpose of this whole thread was whether the term 'illithid' was open for use by non-Wotc publications.  Somewhere along the line it evolved (or devolved depending on your perspective) into the current discussion of what constituted humanoid and so forth.  Steering back to the original matter, unless I am mistaken (which I have been known to be), there are really only two major races in D&D that carry two commonly known and referred to names where both are synonymous; the first being 'Drow' and 'Dark Elf' and the second being 'Mind Flayer' and 'Illithid'.

Why not simply open up the use of the name 'Illithid' only?  Anything other aspect of mind flayer society that was developed as PI by STR?Wotc would remain closed and off-limits.  This would allow free association of the two names and reinforce the mindset of what exactly a mind flayer is without crossing into forbidden territory.  Anyone who wished to develop a publication that went deeper into the mind flayer ecology/society other than what is listed in the SRD, would either have to develop something completely never heard of before or run the risk of venturing into that forbidden territory of PI because of everything other than the illithid name and the other information listed in the SRD being off limits.
