We are talking about a DRAFT document, right? That is, we are talking about a document that is still under development, and has been published for the dual purpose of allowing the creation of OGC products and for discussion by the community of users, right? The comments seem clear. If the creature really IS a unique creation of the old TSR design staff and WotC feels that as such it should be reserved for their use, then I am fine with it. Pull it from the SRD and make it a non-issue. In the state you left it the Monster sections of the SRD encourage divergent development. > There's a hell of a lot of free water in the ocean. Most of them are saying that the existing material is difficult to use. Some are saying that if that is the best that can be done then perhaps it shouldn't be there. Who is begging for more?
