Obviously WotC has the right to defend and keep its own IP.  I have no
problem with that.  But I find your statements and the existing MM sections
at odds with the "safe harbor" concept you tout for the OGL.

If I had a vote, it would be to remove the MM sections from the SRD that
WotC feels are strongly proprietary, and *slightly* loosen the sections that
WotC feels are difficult to defend.  Tempting people to violate your IP by
providing statistics for your proprietary IP doesn't serve anybody's best
interest.
