[Warning. From the conspiracy corner.] No. It is a TREMENDOUS advantage to WotC. By creating an environment where violations almost HAVE to occur, yet these violations are framed by the auspices of a "safe harbor" then WotC creates a tremendous competetive advantage. By selectively enforcing such "small, but technical" licence violations, (i.e. against only companies that they consider are a competetive threat) then WotC can shape the D20 market to ensure that they face no serious competition for market share in their preferred product branches. At least, that's what my masters at the Illuminati told me to say...
