Derivative is basically irrelevant - with the logos the discussion is all about trademark not copyright. So the real issues are confussion & dilution. Since Ryan has already recommended consulting a trademark attorney, I'll just second that advice. At this point the Free/Open 20 group is at the point where no one without specific training & practice in trademark law is really able to offer much in terms of useful advice. Once WotC receives approval for the 'd20 system' trademark logo (if you check the database on trademarks at www.uspto.gov you can find out where they are in the process - last weekend it looked like they are nearly to the point where the process opens up so outsiders can challenge the mark before the uspto grants final approval) WotC is free to attempt to prevent anyone from using any combination of d20, 20, system20, etc. that WotC believes infringes upon their trademark. Even tho the Free/Open logo looks very different graphically, the fact that it uses the number 20 to refer to products based on the exact same material that WotC uses the d20 system logo to refer to may be enough to constitute infringement on/dilution of the d20 system logo. alec _______________________________________________ Ogf-l mailing list [EMAIL PROTECTED] http://mail.opengamingfoundation.org/mailman/listinfo/ogf-l
