The only spells that are available for use as OGC are those posted on the
wizards site (www.wizards.com/d20). Note that some of those spells have
different names than they had in the PHB. You can also use any spells from
third parties that have been released as OGC. Beware of special PI issues
here, sometimes you'll have special requirements for names or descriptions.

You are still free to compile all spells that wizards has released in their
printed books, but you are not allowed to distribute such a work.
