Prior to the OGL, it wasn't considered a big deal to publish a variant
article in a magazine, unless of course you were Palladium. The OGL
creates a safe harbor, but it does not diminish rights you might have
outside that harbor.
Subattributes are not the sole property of WotC; while the inspiration
for this article was of course S&P, there's plenty of other prior art.
I don't think WotC would have an easy time claiming subattributes as
their intellectual property. It's too generic a concept.
