[Winona Online Democracy]

The sentence will depend upon when the 2 previous convictions were.  If a
person has 1 previous dui within 5 years, it is charged as a gross
misdemeanor.  If the person has 2 previous convictions within 10 years it is
also a Gross Misdemeanor.  The gross has a max of one year and $3,000 fine.
The 1st time misdemeanor has a max sentence of 90 days and/or $700.  Often a
judge will sentence for 60 or 90 days plus fines of $400 plus costs
(including a fee of $125 for the alcohol assessment).  Usually much of the
sentence is suspended upon conditions.  If the conditions are violated and
the defendant is caught, the suspended portion of the sentence can be
imposed in whole or in part.  There are no guidelines for misdemeanor or
Gross Misdemeanor sentences, but the judges compare notes as to what others
are doing and try to get some uniformity in the same area.  Judge Benson and
I (Houston & Fillmore Counties) compared notes and tried to do exactly the
same.  It was his idea to impose at least 3 days in jail even for a first
offense.  The variations there were to allow people to do 6 days of
community service in lieu of the 3 days in jail.  We always allowed people
to work off the fines with Community Work Service at $5. per hour.  Your
friend's daughter undoubtedly has some heavy penalties hanging over her
head.  The chickens will come home to roost unless she quits drinking.  The
strongest penalty might be to order her into in-patient treatment.  The
financial penalties associated with that are devastating.  It often results
in a loss of a job, forfeiture of driver's license and sometimes a
confiscation of the car's license.  Judges usually opt for a try at
rehabilitation until convinced that the person is not going to work toward
sobriety.  The only thing left then is to lower the boom with lots of
treatment and jail time.  I hope this information helps.
