Please note, that they jumped on a patch that was never commited, heck, not even concidered to be commited to the repo. I've never seen people so jumpy on _their_ rights on code and shoot anyone who thinks otherwise like the BSDs (not to mention that they tend to ignore other peoples rights). So, IMHO it's best to just ignore them completely. Relicensing might be troublesome, but it can work. In MPlayers history, quite a bit of code was relicensed (both from MPlayer and other projects). It is a tedious work to figure out all contributors and ask them for permission, but it is possible. Overall there are hardly any license problems within the OSS world as people tend to talk to each other about these kind of things and figure out a way how to handle it.
