This will be discussed in Sun. I believe Sun needs to do this, and Sun legal needs to understand, and a Sun representative (like say, Simon Phipps;-) needs to educate the world. There is nothing wrong with the CDDL. You answered my single question that seemed to cause a windfall of responses, yet nobody could answer it. Even so, your answer is not very clear, but good enough. Sun must look into why Debian is not accepting CDDL programs into free, or why they could be placing some/all in non-free. This might not be important for you, but it is for me and I believe it is for our community. Debian is at the show, not far from our booth, I'll probably stop by there at some point, not that there will be anyone there that would be able to help understand things. It all seems like a mis-understanding if it does exist.
