The same thing happens, when you run a lucreate and luupgrade and try to move 
the second disk over to a new system, I would like to see a backup copy 
maintained in the alternate locations. it is also good for a disaster recovery 
situations. at one point I had even submitted a rfe on maintinging alternet 
root copies of menu.lst issue.

But in the case http://www.sun.com/msg/SUNOS-8000-AK this happens when you go 
from 10uX to snv_bXX builds, I had also submitted another RFE, in that menu.lst 
should be maintained going between veriosn, the format of the menu.lst will 
change over time, so a version no should be incorporated along with a backup 
copy. 

back you your second question if you select upgrade the same thing will happen, 
so my recommendation is to backup whatever data or Desktop files then use 
remove both root partitions via newfs each partition and run a initial install. 
if you right click on the background when the language questions are answered 
on DVD install you should see a terminal and open it to get to the command 
shell.
