Good point - but it would be impossible to prove that the (indirect) source of all gathered information really wasn't the spec. On the other hand, it would also be hard to prove the opposite. In the end, it would be a question of money and lawers. But as long as you aren't a direct Adobe competitor (e.g. by claiming a part of the market share), I guess they don't care. In my opinion, the purpose of this license clause is to make sure there will be only *one* Flash Player (as a browser plug-in) and as far as I'm concerned, that's ok..
