In my opinion Microsofts attitude towards the Kinect drivers is just a good face to the matters. Kinect was hacked, and they had to decide whether they pursue the modifications or to allow them and open Kinect for further usage beyond XBox. I personally was very surprised that the decided to do the latter - Microsoft isn't an example of good open source cooperation for me.
