First, there is material which is free or in the public domain and can legally be made available for free from a web site.

Second, just because some web sites get away with illegally distributing music or videos doesn't maen it's legal for others to do it.

I wonder if you're referring to P2P networks where the network providers allow for the sharing and distribution of unprotected material. Plenty of protected material makes it on to these networks, but again, that doesn't make it legal.
