A few people in my state (Ohio) got busted doing that, think its a felony.
My cable modem is a Toshiba 1100 (I think) which comes with the service.
Unless you want to run a server I don't see the point of uncapping your
modem in the first place, speed here is 45KB/Sec UP and 350KB/sec down
(actual speed not Max rated).

You might save a few dollars in buying your own modem (if your provider even
allows you using your own modem), but I am sure the cable company will start
playing games with you when the system isn't running correctly.
