Perhaps he cannot be prosecuted for counterfeiting, since you cannot
counterfeit something that does not exist.  But I am sure a prosecutor
may try to get him for something else - fraud maybe. He did keep the
$198 in change.

On the other hand, I suppose he deserves an award of some sort for
creativity in scamming.
