I have not yet seen anyone refering to Argentine customs. For an
international delivery a customs declaration should have been filled out and
attached to the package by the shipper. Upon arrival in the destination
country the package must first pass through the customs house where any duty
or tax to be collected from the recipient will be assessed before being
released for delivery. Our canadian members should be well versed in this
when receiving deliveries from the US. Anyway, there is a possibility that
the item is still stuck in Argentine customs.
As for the issue of whether it is the shipper or the buyer who is ultimately
responsible for delivery, I tend to side with the buyer...especially when
insurance is not requested. Insurance is one of those things people love to
hate...until they need it. There are alot of folks here in Houston who wish
they had ponied up the cost of flood insurance before tropical storm Allison
came roaring through recently. I know that there have been a number of
people stating law, but I don't know if any of them really know what they
are talking about or just stating how they think it should be. Remember,
the advice received here may be worth no more that what you paid for
it...nada.
I buy and sell (mostly buy) on ebay alot, both domestic and international,
and I have never had a problem. When I buy I realize that if I do not
request/accept insurance it is my problem and I have to deal with the
shipper.
I feel for Albano as he is basically helpless in Argentina dealing with a
seller in Canada. I am impressed by the willingness of our Canadian members
to step up and go to bat for Albano. Good luck Albano.
