I think you are all underestimating the possibilities for gross
stupidity in the American Legal Process. There's nothing in contract law
that says a contract has to be fair to both parties to be legal.

Of course, it depends on what you mean by "fair", but at least in contract law of the Scandinavian countries, a contract regarded as (something like) "grossly, unreasonably unfair" to a party, may be declared invalid. I'd be surprised if not a similar regulation will be found everywhere. (I'm not saying that the EBC terms constituate such a contract, though.)
